Film Fest Gent – General Terms & Conditions of Sale
The Customer agrees to the general terms and conditions of sale when ordering and paying for products.
The products are reserved for the Customer when the order form is submitted. The reservation will be cancelled if the products are not paid for within the specified payment period. This term will be strictly enforced. The Customer will pay the VAT and any other taxes levied on the products, as well as the processing and shipping costs. The shipping costs to be paid by the Customer are clearly displayed upon checkout before the User places the order.
The products can be paid for online through PayPal or by bank transfer. When asked for the details of your payment card you must be fully authorised to use this card or account. The balance on your card or of the account must be sufficient to cover the requested payment. The Customer shall pay for all products purchased in the Film Fest Gent shop prior to delivery. The products will not be delivered until payment has been received. Film Fest Gent does not accept payment on delivery.
Regardless of any price you may previously have seen or heard, from the moment that you select a product that you wish to order, the only applicable price, including VAT (where applicable) and any other delivery costs, will be provided or displayed.
The individual or company placing the order will be considered to be the Customer and is responsible for paying for the order, even if this has to be made out and sent to a third party. The delivery address is the address that the Customer has provided to the organisation. If the Customer changes address then he/she must notify Film Fest Gent of this in writing by sending a letter to the following address: Leeuwstraat 40b, 9000 Ghent, Belgium; or by emailing info@filmfestival.be. You will receive an email confirmation of your order with a detailed overview of the products purchased, the price of these products, the shipping costs and so on.
The fees listed on the shop’s website only apply to the purchase of products by private individuals. Invoices are only made out for the purchase of goods for an amount greater than €250.
Film Fest Gent will process accepted orders as quickly as possible and within 30 days, unless a longer delivery period has been agreed. If the delivery is delayed, or if an order cannot be fulfilled, or can only partially be fulfilled, then the Consumer shall be notified of this as soon as possible.
No discounts can be granted after payment for the products.
The Customer is responsible for the loss or theft of the products. There can be no replacement or refund of the products.
The products remain our property at all times. Consequently copying the products in any form and by any process is strictly prohibited. It is forbidden to sell on products or provide them to third parties for commercial purposes.
The photos on the website are for illustration purposes only. You can check the product’s specific characteristics in the description provided with the product.
We require the requested information and data about you to manage your order(s). The Customer is required to provide us with accurate and correct information on the website and is required to keep this information up to date and inform us of any changes. Film Fest Gent will only accept an online order if the user has identified him/herself in a sufficiently clear manner.

Film Fest Gent will do everything reasonably possible to ensure the information on its website is correct, complete and up to date. However the organisation cannot give any guarantees in this respect and can never be held liable for direct or indirect damage as a consequence of a visit to or the use of the website. Film Fest Gent cannot be held liable for an event of force majeure that delays or prevents the implementation of this Agreement. The following is a non-exhaustive list of events of force majeure: strike, natural disaster, floods, fire, occupation, extreme weather conditions, government measures, technical defects and so on. Film Fest Gent does not have to provide proof of the unforeseen or unavoidable nature of such an event of force majeure. Film Fest Gent has the right to adapt the information and prices provided, or the specifications of the offered products at any time. In accordance with the Data Protection Act of 6 January 1978, amended by the Act of 6 August 2004, you are entitled to access, rectify and oppose the use of your personal data. Alternatively you can send an e-mail to info@filmfestival.be, stating your name, surname and email address. In accordance with the statutory requirements your request has to be duly signed and you need to attach a copy of your ID with your signature and postal address.
The Customer expressly agrees to provide correct, accurate, up-to-date and complete information about him/herself as requested in the registration form. Film Fest Gent retains the right to suspend or refuse the requested transaction when it has reasonable grounds to assume that the provided information is incorrect, incomplete or outdated. This data may be stored to guarantee the proper functioning of Film Fest Gent’s services. The Organiser may also use them for marketing purposes. Every Customer who proves his identity is entitled to have access to his personal data and to amend this, subject to a dated and signed written request which has been submitted beforehand.
These general terms and conditions govern the entire contractual relationship between Film Fest Gent and the Customer and exclude the Customer’s general terms and conditions. Any change, deviation from or addition to these general terms and conditions shall be the subject of a written agreement. If Film Fest Gent does not exercise its rights as provided for in these general terms and conditions this shall not be construed as a waiver of its right to do so in the future. Film Fest Gent has the right to change these general terms and conditions at any time and without prior notice. The changes will take effect as soon as they are published on the website unless otherwise specified. The relationship between the Customer and Film Fest Gent is exclusively governed by Belgian Law. Any disputes shall be decided by the competent courts. Any dispute shall be submitted in writing, no later than eight days after the receipt of the request for payment. The contracting parties shall explicitly accept electronic means (email, fax...) as evidence in their mutual relations.
Film Fest Gent - Algemene verkoopsvoorwaarden
Bij de bestelling en betaling van de producten verklaart de klant zich akkoord met de algemene verkoopsvoorwaarden.
De producten worden gereserveerd op het ogenblik van het verzenden van het bestelformulier. De reservatie wordt geannuleerd indien de producten niet worden betaald binnen de aangegeven betalingstermijn. Deze termijn zal strikt toegepast worden. De BTW en eventuele taksen van de producten zijn steeds ten laste van de klant, alsmede de verwerkings- en verzendingskosten. Deze verzendingskosten zijn niet inbegrepen in de aangeduide prijzen op onze website. De door de klant te betalen verzendkosten worden duidelijk aangegeven vooraleer de gebruiker de bestelling definitief plaatst.
De producten kunnen online via PayPal of overschrijving betaald worden. Wanneer er gevraagd wordt naar de details van uw betaalkaart, dient u over de volledige bevoegdheid te beschikken voor gebruik van deze kaart of rekening. Op de kaart of rekening dient voldoende tegoed te staan om de gevraagde betaling te dekken. Aangekochte producten in de shop van Film Fest Gent worden door de klant vóór de levering betaald. De producten worden niet geleverd zolang de betaling niet ontvangen is. Film Fest Gent aanvaardt geen betaling bij levering.
Ongeacht een prijs die u eerder heeft gezien of gehoord zal, vanaf het moment dat u een product selecteert dat u wenst te bestellen, vermeld of aangeduid worden hoeveel de kosten inclusief BTW, indien van toepassing, en enige andere leveringskosten bedragen.
De persoon of de firma die de bestelling doet wordt aanzien als de opdrachtgever en is verantwoordelijk voor de betaling van de bestelling, zelfs wanneer deze aan een derde moet worden opgesteld en toegezonden. Als plaats van levering geldt het adres dat de klant aan het bedrijf kenbaar heft gemaakt. Indien de klant van adres verandert moet hij Film Fest Gent hiervan schriftelijk op de hoogte brengen op adres: Leeuwstraat 40b, 9000 Gent, België of via mail: info@filmfestival.be. Een bevestiginge van uw bestelling zal u ontvangen per mail met daarin en gedetailleerd overzicht van de aangekochte producten, de prijs van deze producten, de verzendkosten,…
De tarieven opgenomen op de online website van de shop zijn enkel van toepassing op de aankoop van producten door particulieren. Facturen worden enkel opgemaakt bij aankoop goederen vanaf een bedag van 250€.
Film Fest Gent zal de geaccepteerde bestellingen met bekwame spoed doch uiterlijk binnen 30 dagen uitvoeren tenzij een langere leveringstermijn is afgesproken. Indien de bezorging vertraging ondervindt, of indien een bestelling niet dan wel slechts gedeeltelijk kan worden uitgevoerd, ontvangt de consument hiervan zo snel mogelijk bericht.
Na betaling van de producten kunnen er achteraf geen kortingen meer toegekend worden.
Verlies of diefstal van producten zijn de verantwoordelijkheid van de klant en geeft geen mogelijkheid tot vervanging of terugbetaling.
De goederen blijven steeds onze eigendom. Bijgevolg is elke nabootsing onder welke vorm ook en met om het even welk procédé strict verboden. Het is verboden de producten door te verkopen of om deze om commerciële redenen aan derden te verschaffen.
De foto’s op de webpagina dienen als illustratie. De specifieke kenmerken van het product kan u raadplegen via de beschrijving dat bij het product vermeld staat.
De gevraagde informatie en gegevens over u zijn noodzakelik voor het beheer van uw bestelling(en). De klant dient aan ons en op de site exacte en juiste informatie door te geven en is gehouden deze informatie up-to-date te houden en ons te informeren over eventuele wijzigingen. Film Fest Gent aanvaard een online bestelling pas als de gebruiker zich voldoende duidelijk heft geïdentificeerd.

Film Fest Gent wendt alle redelijke middelen aan om de informatie op haar website correct, volledig en up-to-date te houden. Film Fest Gent is niet aansprakelijk voor overmacht die de uitvoering van deze overeenkomst vertraagt of verhindert. Worden onder meer maar niet uitsluitend als overmacht beschouwd: staking, natuurrampen, overstroming, brand, bezetting, extreme weersomstandigheden, overheidsmaatregelen, technische defecten,… Film Fest Gent dient niet het bewijs te leveren van de onvoorziene of onvermijdbare aard van dergelijke situatie van overmacht. Film Fest Gent heeft het recht om de gegeven informatie en prijzen of de kenmerken van het aangeboden goed op om het even welk moment aan te passen. In overeenstemming met de Wet inzake Informatica en Vrijheden van 6 januari 1978, gewijzigd door de wet van 6 augustus 2004, hebt u recht op toegang tot, rectificatie van en verzet tegen uw persoonlijke gegevens. U kan zich hiervoor per post richten op adres: Leeuwstraat 40b, 9000 Gent, België of via mail: info@filmfestival.be, met de vermelding van uw voornaam, achternaam en e-mail adres. In overeenstemming met de wettelijke voorschriften, moet uw aanvraag worden ondertekend en worden vergezeld van een fotokopie van een legitimatiebewijs met uw handtekening en uw postadres.
De klant gaat uitdrukkelijk akkoord om correcte, accurate, actuele en volledige informatie over zichzelf te verstrekken zoals gevraagd op het registratieformulier. Film Fest Gent behoudt zich het recht voor om, wanneer zij redelijke vermoedens heeft dat de verstrekte informatie onjuist, onvolledig of voorbijgestreefd is, de gevraagde verrichting te schorsen of te weigeren. Deze gegevens kunnen bewaard worden om de goede werking van haar diensten te kunnen garanderen. Zij kunnen tevens worden gebruikt door de organisator voor marketingdoeleinden. Elke klant die zijn identiteit bewijst, is gerechtigd om toegang te krijgen tot zijn persoonsgegevens en om verbeteringen hieraan aan te brengen, mits voorafgaandelijk gedagtekend en ondertekend schriftelijk verzoek.
Deze algemene voorwaarden beheersen de volledige contractuele relatie tussen Film Fest Gent en de klant, met uitsluiting van de algemene voorwaarden van de klant. Elke wijziging of afwijking hiervan of elke toevoeging dient het voorwerp van een geschreven overeenkomst uit te maken. De niet-uitoefening van haar rechten bepaald in deze algemene voorwaarden door Film Fest Gent kan niet beschouwd worden als een afstand van haar recht dit wel te doen in de toekomst. Film Fest Gent heeft het recht deze algemene voorwaarden op elk ogenblik, en zonder voorafgaande verwittiging, te wijzigen. De wijzigingen worden van kracht vanaf het ogenblik dat zij op de website verschijnen, tenzij anders bepaald. De verhoudingen tussen de klant en Film Fest Gent worden enkel beheerst door het Belgische Recht. Eventuele geschillen zullen worden voorgelegd aan de bevoegde Rechtbanken. Iedere betwisting dient schriftelijk te gebeuren, ten laatste 8 dagen na ontvangst van het verzoek tot betaling. Partijen aanvaarden in hun onderlinge relaties uitdrukkelijk elektronische middelen (e-mail, fax,…) als bewijsmiddelen.
Film Fest Gent – Conditions générales de vente
Lors de la commande et du paiement des produits, le client déclare accepter les conditions générales de vente.
Les produits sont réservés au moment de l'envoi du formulaire de commande. La réservation est annulée si les produits ne sont pas payés dans le délai de paiement indiqué. Ce délai est appliqué de manière stricte. La TVA et les éventuelles taxes sur les produits sont toujours à charge du client, de même que les frais de traitement et d'envoi. Ces frais d'envoi ne sont pas compris dans les prix mentionnés sur notre site Internet. Les frais d'envoi que le client doit payer sont clairement indiqués avant que la commande de l'utilisateur soit définitive.
Les produits peuvent être payés en ligne via PayPal ou par virement. Lorsque les détails de votre carte de paiement sont demandés, vous devez disposer de l'entière compétence d'utiliser cette carte ou ce compte. La carte ou le compte doivent être suffisamment approvisionnés pour couvrir le paiement demandé. Les produits achetés dans le magasin du Film Fest Gent sont payés par le client avant leur livraison. Les produits ne sont pas livrés tant que le paiement n'a pas été reçu. Le Film Fest Gent n'accepte aucun paiement à la livraison.
Indépendamment d'un prix que vous auriez vu ou entendu auparavant, le montant des frais, TVA incluse si d'application, ainsi que de tout autre frais de livraison est mentionné ou précisé, à partir du moment où vous sélectionnez un produit que vous souhaitez commander.
La personne ou la société qui passe commande est considérée comme le donneur d'ordre et est responsable du paiement de la commande, même lorsque cette dernière doit être établie pour et envoyée à un tiers. Le lieu de livraison est l'adresse que le client a communiquée à l'entreprise. Vous recevrez par e-mail une confirmation de votre commande reprenant un aperçu détaillé des produits achetés, le prix de ces produits, les frais d'envoi, …
Les tarifs repris sur le site Internet du magasin ne sont valables que pour l'achat de produits par des particuliers. Les factures ne sont établies que pour l'achat de biens à partir d'un montant de 250 €.
Le Film Fest Gent envoie les commandes acceptées avec promptitude, mais au plus tard dans les 30 jours, sauf si un délai de livraison plus long a été convenu. Si la livraison subit un retard ou si une commande ne peut pas être envoyée ou ne peut l'être que partiellement, le client en est informé au plus vite.
Une fois les produits payés, plus aucune réduction ne peut être appliquée a posteriori.
La perte ou le vol de produits relève de la responsabilité du client et ne donne pas lieu à un remplacement ou à un remboursement.
Les biens restent toujours notre propriété. Dès lors, toute contrefaçon, sous quelque forme que ce soit et par quelque procédé que ce soit, est strictement interdite. Il est interdit de revendre les produits ou de les fournir à des tiers dans une relation commerciale.
Les photos sur les pages Internet servent d'illustration. Vous pouvez consulter les caractéristiques spécifiques du produit dans la description mentionnée auprès du produit.
Les informations et données vous concernant qui sont demandées sont nécessaires pour la gestion de votre(vos) commande(s). Le client doit nous communiquer, sur le site Internet, des informations exactes et correctes et il est tenu de mettre ces informations à jour et de nous informer d'éventuels changements. Le Film Fest Gent n'accepte une commande en ligne que si l'utilisateur s'est identifié de manière suffisamment claire.
Le Film Fest Gent garantit la protection des données à caractère personnel. Le Film Fest Gent se réserve le droit, s’il a des raisons de présumer que les informations communiquées sont inexactes, incomplètes ou désuètes, de suspendre ou de refuser l'opération demandée. Ces données peuvent être conservées afin de garantir le bon fonctionnement de ses services. Elles peuvent en outre être utilisées par l'organisateur à des fins de marketing. Tout client attestant de son identité a le droit d'accéder à ses données à caractère personnel et d'y apporter des rectifications, moyennant une demande écrite préalable datée et signée.
Les présentes conditions générales régissent l'intégralité de la relation contractuelle entre le Film Fest Gent et le client, excluant les conditions générales du client. Toute modification de ou dérogation à celles-ci ou tout ajout doit faire l'objet d'une convention écrite. Le non-exercice de ses droits énoncés dans les présentes conditions générales par le Film Fest Gent ne peut pas être considéré comme une renonciation de son droit de les exercer ultérieurement. Le Film Fest Gent a le droit de modifier les présentes conditions générales à tout moment et sans avertissement préalable. Les modifications entrent en vigueur dès le moment où elles figurent sur le site Internet, sauf mention contraire. Les relations entre le client et le Film Fest Gent sont exclusivement régies par le droit belge. Les éventuels litiges sont soumis aux tribunaux compétents. Toute contestation doit être faite par écrit au plus tard 8 jours après réception de la demande de paiement. Dans leurs relations mutuelles, les parties acceptent expressément que les moyens électroniques (e-mail, fax, …) aient force de preuve.
